A. Terms and Conditions of Sale

You must accept these terms and conditions of sale in order to make the purchase of Turbo-Tuner USB. By purchasing Turbo-Tuner USB you agree to be bound by these terms and conditions of sale.

1. Cancellation and your Right to Cancel (Cooling Off Period)

If you are a UK customer, you have a statutory right to cancel your order within 7 days of receipt. You may do this by taking or sending by post or e-mail a WRITTEN notice of cancellation to:

Important - If you have opted for the Conversion Service, the cooling off period applies from the date that the order was made, and you lose your right to cancel from the moment you authorise us (by email or in writing) to proceed with the conversion service. Until that point you can exercise your right to cancel within 7 days of the date that the order was made, as detailed above. During the 7 day cooling off period we will not proceed with the work until we receive written (by email or by post) authorisation from you. If the cooling off period has elapsed without receiving any authorisation from you to proceed with the conversion service, then we will automatically proceed with the work and dispatch the item to you. Any delay in your authorisation during the cooling off period will result in a delay in dispatching the item back to you.

When returning goods, please supply your full name and address and include a copy of your receipt. Any order returned to us without this information will be refused. You have until the expiry of seven working days (i.e. excluding Saturday, Sunday, bank holidays and public holidays), starting with the day after the products are delivered (or in the case of the Conversion Service, from the date that the order was made), to exercise this right. If you exercise your right to cancel, any money you have paid for your order will be refunded not including your expense of returning the products.

If you wish to exercise your right to cancel, you must also take good care of the products until you return them and ship the product to us. All items must be returned unused in their original packaging and in a saleable condition and the software license seal must not be broken. A broken software license seal will deem the product to have been used and therefore non-returnable. All returns must be well packaged to protect items from damage in transit. Any damage that occurs in transit to the return address will be deemed to be the responsibility of the customer and any costs arising from this will be for the customers account. All returns should be sent using an insured postal service. We do not accept proof of postage as proof of delivery.

You must first obtain our authorisation prior to returning any items. We will send you (via email) a return authorisation. No product may be returned for any reason without our authorisation. Customer is responsible for returning products to the return address at the customer's risk and expense. uLogix Ltd shall not be responsible for failure of the delivery service to make on-time delivery. Customer must ship the product to the return address in the original packaging, prepaid and insured, including a copy of the original receipt.

Please note that once you have been issued with our authorisation to return the goods, then the goods to be returned should be despatched promptly via insured delivery service to the return address above. All goods to be returned must be returned within 14 days of issue of the return authorisation. Any goods not returned within a 14 day period following issue of the return authorisation may be subject to additional charges or in certain circumstances become non-refundable.

3. Items out of stock

For off-the shelf Turbo-Tuner USB (stock item), if we don't have the ECU number you requested in stock then we will contact you and offer you either a compatible ECU or we will try to source an identical ECU. If we are out of stock then it may take some time to source an ECU in which case we will keep you informed as to our progress. If in the mean time you manage to source your own ECU then please send it to us and let us know immediately and we will refund the difference between the price of the off-the-shelf item and the price of the conversion service item. Delivery costs will remain the same.

4. Turbo-Tuner USB Hardware Warranty

a) Off-the-Shelf Product: Covers the complete ECU including any specific Turbo-Tuner USB components.

Turbo-Tuner USB purchased as an off-the-shelf stock product is guaranteed for a period of one year from the date of receipt, with the exception of the ECU itself which is guaranteed for 30 days from the date of receipt. During the warranty period, should the Turbo-Tuner USB components develop a fault due to faulty workmanship or faulty components, the product will be either repaired or replaced free of charge subject to the faulty product being returned for repair. If the product has been tampered with, or an attempt has been made to tamper with it, or has been damaged as a result of misuse, incorrect use, incorrect installation, static electrical discharge, or any other direct or indirect cause not related to the workmanship or components used in the product, then the product guarantee will be void and any repairs will be chargeable to the customer.

b) Conversion Service: Includes cover for the components used to convert the customer supplied ECU to a Turbo-Tuner USB ECU. Excludes cover for the actual ECU supplied by the customer.

Turbo-Tuner USB purchased using the Conversion Service is guaranteed for a period of one year from the date of receipt. During the warranty period, should the Turbo-Tuner USB components develop a fault due to faulty workmanship or faulty components, the product will be either repaired or replaced free of charge subject to the faulty product being returned for repair. If the product has been tampered with, or an attempt has been made to tamper with it, or has been damaged as a result of misuse, incorrect use, incorrect installation, static electrical discharge, or any other direct or indirect cause not related to the workmanship or components used in the product, then the product guarantee will be void and any repairs will be chargeable to the customer.

No warranty is given, express or implied, for any computer equipment used to connect to the Turbo-Tuner USB hardware.

B. Terms and Conditions of Use

Definitions:

SOFTWARE PRODUCT: Turbo-Tuner USB Software.
HARDWARE PRODUCT: Turbo-Tuner USB ECU with USB interface.
PRODUCT: Both the Turbo-Tuner USB ECU and the Turbo-Tuner USB Software.

Terms and conditions of use:

1. This PRODUCT is designed for OFF-ROAD and RACE-TRACK use only. It is not designed for use on the public highway.

2. If you are unfamiliar with engine tuning, you should not tune the car by yourself. Let a qualified tuning specialist tune the car for you. It is highly recommended that you tune the car on a rolling road. Incorrect adjustment of any of the parameters could result in catastrophic engine failure. To tune the engine correctly in order to achieve safe and reliable performance, you should be proficient at adjusting the fueling, turbo pressure and ignition timing correctly and understand the consequences of making these adjustments.

3. You should ensure that you have the following equipment installed and correctly functioning prior to any tuning work being carried out:

    a) Wideband Lambda / AFR sensor to accurately monitor engine fueling.
    b) A suitable and accurate turbo boost pressure gauge.

Without this equipment installed to monitor fueling and turbo pressure, you risk catastrophic engine failure. It is also highly recommended that you keep this equipment installed and functioning after the tuning is complete so that you can continue to monitor the fueling and boost pressure to ensure that the engine continues to run safely and reliably.

4. Incorrect adjustment of fueling, ignition timing, or boost pressure could result in catastrophic engine failure.

5. If tuning the car off-road or on the race track in real time, you should use a second person to operate the laptop and carry out the tuning work. The driver should not drive and use this software at the same time!

6. This SOFTWARE PRODUCT is only designed for use with the HARDWARE PRODUCT for the Volvo 5 cylinder turbocharged petrol engines from model year 1993-1998 equipped with a throttle cable and a distributor ignition system. Do not attempt to use this PRODUCT with any other type other engine.

7. Do not use the Motronic 4.3 ECU in a Motronic 4.4 car as damage may occur to some of the ancillary equipment such as the air-conditioning system.

8. The HARDWARE PRODUCT is a modified Volvo OEM engine management system. No warranty is given, express or implied, for any other part of the vehicle.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL ULOGIX LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE, INCORRECT USE OR MISUSE USE OF THE PRODUCT, EVEN IF ULOGIX LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ULOGIX LTD BE LIABLE FOR ANY COMPUTER DAMAGE, VEHICLE DAMAGE, PERSONAL INJURY, DEATH, FINES, LAWSUITS, PROSECUTION, LOST PROFITS, LOST DATA, INCORRECT DATA, ENVIRONMENTAL DAMAGE, GOVERNMENT, LAW AND REGULATORY VIOLATIONS OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE, INCORRECT USE OR MISUSE OF THE PRODUCT.

THIS PRODUCT IS NOT INTENDED FOR AND MUST NOT BE USED IN OPERATION OF MOTOR VEHICLES AND/OR MACHINES WHERE THE USE, FAILURE OR MISUSE OF THE PRODUCT COULD LEAD TO DEATH, PERSONAL INJURY OR PHYSICAL OR ENVIRONMENTAL DAMAGE AND OR VIOLATE ANY ENVIRONMENTAL, SAFETY, TRANSPORTATION OR OTHER LAWS OR REGULATIONS.
